ไทยเข้าร่วมการประชุมคณะทำงาน ๓ ภายใต้ UNCITRAL ผลักดันการปฏิรูปกลไก ISDS
เมื่อวันที่ ๑-๕ เมษายน ๒๕๖๗ นางสุพรรณวษา โชติกญาณ ถัง อธิบดีกรมสนธิสัญญาและกฎหมาย เข้าร่วมการประชุมคณะทำงาน ๓ สมัยที่ ๔๘ ภายใต้คณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ (UNCITRAL) ณ นครนิวยอร์ก เพื่อหารือเกี่ยวกับการปฏิรูปกลไกการระงับข้อพิพาทระหว่างรัฐกับเอกชน (ISDS) ที่ประชุมได้บรรลุการจัดทำร่างตราสารเพื่อจัดตั้งศูนย์ให้คำปรึกษาด้านการระงับข้อพิพาทด้านการลงทุนระหว่างประเทศ (Advisory Centre on International Investment Dispute Resolution: ACIIDR) จนแล้วเสร็จ เพื่อเตรียมเสนอเข้าสู่การพิจารณาของที่ประชุม UNCITRAL ต่อไปในเดือนกรกฎาคม ปีนี้
นอกจากนี้ คณะทำงาน ๓ ยังได้พิจารณาการปฏิรูปกลไก ISDS อีก ๒ หัวข้อ ได้แก่ ร่างแนวทางการป้องกันและบรรเทาข้อพิพาทด้านการลงทุนระหว่างประเทศ และร่างตราสารว่าด้วยการจัดตั้งกลไกพหุภาคีถาวรด้วย
การจัดตััง ACIIDR เป็นข้อเสนอการปฏิรูปกลไก ISDS ที่มุ่งเสริมสร้างขีดความสามารถและให้บริการทางกฎหมายแก่ประเทศกำลังพัฒนาเพื่อให้มีความพร้อมในการรับมือข้อพิพาทด้านการลงทุนระหว่างประเทศ โดยไทยเป็นหนึ่งในประเทศที่ผลักดันการจัดตััง ACIIDR ในคณะทำงาน ๓ ตั้งแต่ปี ๒๕๖๑ และสามารถบรรลุการจัดทำร่างตราสารฯ ได้สำเร็จในการประชุมครั้งนี้

Thailand attends 48th session of the UNCITRAL’s Working Group III (ISDS Reform) to push forward ISDS reform
On 1-5 April 2024, Mrs. Suphanvasa Chotikajan Tang, Director-General of the Department of Treaties and Legal Affairs, attended the 48th session of the UNCITRAL’s Working Group III (Investor-State Dispute Settlement Reform: ISDS Reform) at the United Nations Headquarters in New York.
The Working Group achieved another milestone by completing the draft statute of an Advisory Centre on International Investment Dispute Resolution (ACIIDR), which will be submitted to the UNCITRAL Commission for consideration in July later this year.
In addition, the Working Group also deliberated on two other ISDS reform initiatives, namely, the draft guidelines on prevention and mitigation of international investment disputes; and the draft statute of a standing mechanism for the resolution of international investment disputes.
The ACIIDR aims to support developing countries in terms of technical assistance and capacity-building, as well as legal services in international investment dispute resolution. Thailand has been a strong advocate for establishing the ACIIDR from the outset since 2018 and is taking a leading role in expediting its establishment.
