เมื่อวันที่ ๕ มีนาคม ๒๕๖๙ นายเบญจมินทร์ สุกาญจนัจที อธิบดีกรมสนธิสัญญาและกฎหมาย ได้ร่วมกล่าวเปิดการประชุมที่ปรึกษากฎหมายภาครัฐภูมิภาคเอเชีย-แปซิฟิก ในประเด็นการปรับใช้และท่าทีของประเทศในการตีความและการปรับใช้กฎหมายระหว่างประเทศในมิติไซเบอร์ ผ่านมุมมองจากภูมิภาคเอเชีย-แปซิฟิก ณ คณะนิติศาสตร์ จุฬาลงกรณ์มหาวิทยาลัย โดยกระทรวงการต่างประเทศ ได้เป็นเจ้าภาพร่วมกับ คณะนิติศาสตร์ จุฬาลงกรณ์มหาวิทยาลัย มหาวิทยาลัยเอ็กเซเตอร์ กระทรวงการต่างประเทศญึ่ปุ่น และ NATO Cooperative Cyber Defence Centre of Excellence (CCDCOE) ซึ่งการประชุมมีวัตถุประสงค์เพื่อหารือแนวทางการพัฒนาและปรับปรุงท่าทีของประเทศในการตีความและปรับใช้กฎหมายระหว่างประเทศในมิติไซเบอร์สำหรับภูมิภาคเอเชีย-แปซิฟิก ซึ่งถือเป็นหัวใจสำคัญที่แสดงให้เห็นถึงบทบาทของกฎหมายระหว่างประเทศในการกำกับดูแลพฤติกรรมของรัฐในมิติไซเบอร์อย่างมีความรับผิดชอบ

ในที่ประชุม นายเบญจมินทร์ฯ ได้เน้นย้ำว่าการมีท่าทีในประเด็นดังกล่าวจะช่วยให้มีความคาดการณ์ได้ ความโปร่งใสและเสถียรภาพในมิติไซเบอร์ ซึ่งจะนำไปสู่ความเข้าใจร่วมกันและความร่วมมือระหว่างกันเพื่อรักษาความมั่นคงระหว่างประเทศ นอกจากนี้ นายปวีณ ธนรัช นักการทูตชำนาญการพิเศษ
ได้ร่วมอภิปรายเพื่อแลกเปลี่ยนประสบการณ์เกี่ยวกับกระบวนการ ประสบการณ์ และความท้าทายในการจัดทำท่าทีของประเทศ ร่วมกับผู้เชี่ยวชาญด้านกฎหมายระหว่างประเทศจากประเทศในภูมิภาคร่วมอภิปรายและแลกเปลี่ยนความเห็นทั้งในฐานะประเทศที่ได้มีการจัดทำและเผยแพร่ท่าทีของประเทศไปก่อนแล้ว ประเทศที่อยู่ระหว่างการจัดทำท่าที และในฐานะผู้จัดทำคู่มือเกี่ยวกับการจัดทำท่าทีของประเทศ

ประเทศไทยได้จัดทำและเผยแพร่ท่าทีของประเทศในประเด็นการปรับใช้และตีความกฎหมายระหว่างประเทศในมิติไซเบอร์แล้วเมื่อวันที่ ๘ กรกฎาคม ๒๕๖๘ โดยก้าวต่อไปที่สำคัญคือการส่งเสริมความร่วมมือทางไซเบอร์โดยเฉพาะในระดับภูมิภาคที่จับต้องได้ เพื่อหารือถึงแนวทางและท่าทีร่วมกันในการพัฒนาพื้นฐานของความมั่นคงปลอดภัยทางไซเบอร์ต่อไป 

Governmental Legal Advisors' Roundtable on National Positions on International Law and Cyber Activities: Asia-Pacific Perspectives

On 5 March 2026, Mr. Benjamin Sukanjanajtee, Director-General of the Department of Treaties and Legal Affairs, delivered opening remarks at the Governmental Legal Advisors' Roundtable on National Positions on International Law and Cyber Activities: Asia-Pacific Perspective, which was held at the Faculty of Law, Chulalongkorn University. The Ministry of Foreign Affairs of Thailand co-hosted the Roundtable with the Faculty of Law, Chulalongkorn University, University of Exeter, the Ministry of Foreign Affairs of Japan, and the NATO Cooperative Cyber Defence Centre of Excellence (CCDCOE). The objective of the Roundtable was to discuss the process of developing national positions on the application and interpretation of international law in cyberspace for the Asia-Pacific Region, including its amendment. Such efforts are central to demonstrating the role of international law in guiding responsible State behaviour in cyberspace.

At the Roundtable, Mr. Benjamin emphasised that national positions on such issues would enhance predictability, transparency and stability in cyberspace, which are crucial to maintaining international peace and security by fostering shared understanding and cooperation among States. Additionally, Mr. Paween Thanarat, Minister Counsellor, participated as a panelist to share Thailand’s experiences regarding the process, lessons learned, and challenges in developing country’s national position. The international law experts and academics from countries across the region also joined the Roundtable to exchange views and perspectives, both as representatives of States that have already developed and published their national positions, States currently in the process of developing their positions, and experts involved in preparing practical guidance on the development of national positions.

Thailand developed and published its National Position on the Application of International Law in Cyberspace on 8 July 2025. The next significant step is to promote tangible cyber cooperation, particularly at the regional level, in order to discuss possible common positions for further developing and strengthening the foundations of cybersecurity.
