เมื่อวันที่ ๙ ธันวาคม พ.ศ ๒๕๖๘ คณะรัฐมนตรีมีมติเห็นชอบให้ไทยเข้าเป็นภาคีอนุสัญญาว่าด้วยการยกเลิกข้อกำหนดของการนิติกรณ์สำหรับเอกสารมหาชนต่างประเทศ (Convention Abolishing the Requirement of Legalisation for Foreign Public Documents) ซึ่งเป็นหนึ่งในอนุสัญญาสำคัญภายใต้กรอบงานของที่ประชุมแห่งกรุงเฮกว่าด้วยกฎหมายระหว่างประเทศแผนกคดีบุคคล (The Hague Conference on Private International Law - HCCH) การเข้าเป็นภาคีอนุสัญญาดังกล่าวจะช่วยลดขั้นตอนและค่าใช้จ่ายในการรับรองเอกสารที่จะนำไปใช้ในต่างประเทศและที่จะนำมาใช้ในประเทศไทย ทำให้ประชาชนและภาคธุรกิจที่มีความจำเป็นต้องรับรองเอกสารได้รับความสะดวกมากยิ่งขึ้น
ทั้งนี้ กระทรวงการต่างประเทศจะดำเนินการยื่นภาคยานุวัติสารต่อกระทรวงการต่างประเทศเนเธอร์แลนด์ในฐานะผู้เก็บรักษาตามอนุสัญญาฯ เพื่อให้อนุสัญญาฯ มีผลใช้บังคับกับประเทศไทยต่อไป
ความสำเร็จของการเข้าเป็นภาคีอนุสัญญานี้ เป็นผลงานการขับเคลื่อนของคณะอนุกรรมการพิจารณาแนวทางการเข้าเป็นภาคีอนุสัญญาว่าด้วยการยกเลิกข้อกำหนดของการนิติกรณ์สำหรับเอกสารมหาชนต่างประเทศ ซึ่งมีเอกอัครราชทูตวิลาวรรณ มังคละธนะกุล เป็นประธาน ภายใต้คณะกรรมการระดับชาติเพื่อขับเคลื่อนการดำเนินการภายหลังประเทศไทยเข้าเป็นสมาชิก HCCH ซึ่งมีรัฐมนตรีว่าการกระทรวงยุติธรรมเป็นประธาน
On 9 December 2025, the Cabinet passed a resolution approving Thailand’s accession to the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents, which is one of the key conventions under the framework of the Hague Conference on Private International Law (HCCH). Accession to this Convention will help reduce procedures and costs related to document legalisation, thereby providing greater convenience for members of the public and the business sector necessitating document legalisation.
The Ministry of Foreign Affairs will proceed to deposit the instrument of accession with the Ministry of Foreign Affairs of the Netherlands, in its capacity as the depository of the Convention, in order for the Convention to enter into force for Thailand.
The success of this accession is a result of the work driven by the Sub-committee on the Consideration of Accession to the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents. This body is chaired by Ambassador Vilawan Mangklatanakul and operates under the National Committee on the Implementation of Thailand’s Membership to the HCCH, chaired by the Minister of Justice.
